Pending legislation (SB 75) will loosen restrictions related to zoning but will likely result in litigation against the Office of the Marijuana Commissioner by Sussex County. As of late July, Governor Matt Meyer still hasn't picked up the bill to officially start the 10-day clock ticking for him to veto, sign, or let the bill pass by default. This conflict is expected to significantly and further delay the adult-use roll out.
After moving from a vertical supply-demand chain, the Delaware wholesale market currently serves the 13 medical dispensaries that have converted to adult-use and will begin serving the public August 1, 2025.
Two operators currently supply most of the market in addition to their own five stores.
