Pending legislation (SB 75) would have significantly loosened restrictions related to zoning but would have certainly resulted in litigation against the Office of the Marijuana Commissioner by Sussex County. Unfortunately, Governor Matt Meyer vetoed the bill, further delaying the adult-use roll out.
Sussex County is currently considering a new ordinance to amend the current Ordinance 3016, hopefully moving as quickly as they can due to rumors of a special session for the legislature to override the veto. Stay tuned.
After moving from a vertical supply-demand chain, the Delaware wholesale market currently serves the 13 medical dispensaries that have converted to adult-use and began serving the public August 1, 2025.
Two operators currently supply most of the market in addition to their own five stores.
Adult-use cannabis sales began August 1, 2025 and the first full month of sales totaled $7.4MM
