Pending legislation (SB 75) would have significantly loosened restrictions related to zoning but would have certainly resulted in litigation against the Office of the Marijuana Commissioner by Sussex County. Unfortunately, Governor Matt Meyer vetoed the bill, further delaying the adult-use roll out. The override of SB 75 has been successful in the Senate, though it remains to be seen what happens in the House.
After moving from a vertical supply-demand chain, the Delaware wholesale market currently serves the 14 medical dispensaries that have converted to adult-use and began serving the public August 1, 2025.
Two operators currently supply most of the market in addition to their own five stores.
Licenses available are in all three counties, some are Social Equity, some are Micro.
