There is a tremendous and hardly unusual amount of uncertainty attached to the Delaware adult-use rollout.
The incumbent medical operators will have a long runway to serve Delawareans aged 21 and older before those awarded licenses in the 2024 lottery.
SB 75 would have loosened restrictions but was vetoed by Governor Matt Meyer on August 28, 2025. Prohibitively restrictive zoning must now be amended by Sussex County Ordinance 3016 to give new operators a better chance of success in standing up their licenses with compliant real estate.
As it stands, there are a few wrinkles for some vertical medical operators that paid hefty conversion fees.
1. The Farm had issues with opening an adult-use store in Frankford, but was able to resolve the issue and get open by 8/1/25. Municipalities have long differentiated between medical and adult-use, and tolerance varies widely in some instances.
2. Best Buds has a Trolley Square dispensary at 1404 N Dupont St that was recently served a cease and desist for the same reason. (For context, John Carney, the former Governor of Delaware that slowchecked legalization is now the Mayor of the City of Wilmington and the ex officio figurehead of the NIMBYism that will keep the COW from having the right number of stores in the right locations. Plenty of smokeshops and liquor stores though.)
These headwinds will delay the industry from becoming robust as well as keep the legislators and the litigators busy so stay tuned.
