Pending legislation (SB 75) would loosen restrictions related to zoning but Governor Matt Meyer is apparently leaning toward a veto. This will likely result in litigation against the Office of the Marijuana Commissioner and Sussex County. However it shakes out, this conflict is expected to significantly and further delay the adult-use roll out.
In the Sussex County city of Seaford, council voted to remove a condition that would allow two adult-use retails only upon legalization at the federal level. That would allow Fresh, who has already paid the $100,000 conversion fee, to serve customers 21 and older instead of only medical patients.
Seaford is also considering a $50,000 cannabis license fee, but no more on that just yet.
Incumbent operators have plenty of runway and the medical dispensaries that converted to adult-use will have high prices and long lines for some time to come.
Fun fact: 38% of the currently operating Delaware cannabis dispensaries are owned by larger MSOs.
